You have to make sure you've obtained counsel that follows through. What if your father died 20 years ago, and the will was probated, but now looking to do your own will, you find that the property is still in your father's name?

The only clear way to avoid these things is make sure the attorney you are using works with you, not just for you, to make sure all complexities are addressed timely.
A great deal of probate work is done going back over old estates and fixing them. You don't have to fix what was put together properly in the first place.
