We have recently started to dialogue with all the attorneys who are in the Probate Section of the Massachusetts Bar Association. We post questions to get peer feedback. One being about what your options are in filing a limited formal probate, which the Code says you are restricted to as an option if the estate is over 3 years old and nothing has been done.
We have two cases going right now where that is a significant issue. Where there are a host of potential heirs, it can be a real problem roadblocking resolution unless all involved can be put on the same page.
Estate planning is impossible if you don't even do basics; and certainly so if you let years go by without probating a deceased person's estate who died owning an interest in land. Can't stress enough, or repeat enough, the need to take an hour, go over your situation, and make some basic plans.
